TJL Calls for Closing “Data Broker Loophole” to Address AI Mass Surveillance Capabilities

Tech Justice Law was among more than 130 organizations who urged Congressional leaders to ensure that any reauthorization of Section 702 of the Foreign Intelligence Surveillance Act (FISA) closes the “data broker loophole.” Commercial data brokers sell private information about people, often obtained surreptitiously from our phones or other internet-connected devices. With the analytic powers of AI, that mass of private data can be converted into detailed portraits of the lives of everyone in the U.S., and the New York Times has reported that the Department of Defense wants AI companies to agree to provide exactly that service. The upcoming FISA reauthorization vote is a critical opportunity to close the data broker loophole at a moment when AI companies are poised to enable a profound escalation in invasive surveillance practices.
